Do I Qualify for an E-2 Visa?

To qualify for E-2 classification, you must meet the following requirements:

  • You must be a national from a country that maintains a trade treaty relationship (either navigation, commerce, or an equivalent), which is also known as the Department of State’s Treaty Countries
  • You must have invested, or must be in the process of investing substantial capital in a legitimate U.S. business (including services or technology).
  • You must prove that you are coming to the U.S. with the purpose of developing and directing the investment opportunity in which you have invested capital.
  • You must show that you have control of the business, investment, or enterprise (by way of operational control, managerial control, or other corporate control).
